I have a few questions Mr Spencer could perhaps answer:
1. When Walter was interviewed and after everyone felt he was "100% the man for the job" did anyone check his background in to what his behavior was on the road and when away from family? Surely someone could have commented on this and said he was a loyal, family man or no. Supposedly Brad Stevens was one who put in a good word for Walter, did he know of this? I mean people who carry on like he did don't usually just wake up one day and start with this behavior.
2. A small red flag when he told people his wife and family were not moving to Evansville right away and then a much bigger red flag when they did not at the end of the 2018 school year. Did anyone start wondering at that point? Did Graves and Lickliter see this coming and took off right away so their reputation was not tarnished along with Walter.
3. Walter "WAS" Spencer's ticket out of town should we have reached the NCAA tournaments and reached much higher levels than we have in 20 years, so my gut tells me he would be more likely to be one to hope and pray like mad that Walter behaved. I hope he was smart enough to document and go to Prez P right away once his behavior came to light. Once word was out he was acting like a 25 year old it was just a matter of time before this behavior ended his employment.
If it is found Spencer did not report his suspicions and facts early on he should be fired for sure. I am not sure he should not be canned anyway.
Lastly, what an idiot Walter was. He could have had the community wrapped around his finger for years to come had he done things the right way and now his name is tarnished forever and he may end up banned from NCAA or put in jail before the dus settles. Clearly his "ego" and "I am entitled" mentality took over. I can't imagine he will be married much longer. Sad for all involved.

I think that everyone would be shocked at who this student is, I know I was and I wish I would’ve stood up and said how inappropriate he was when I saw him out and about town. She is well respected at UE and throughout the community. She has a lot of integrity and her life has been turned upside down since this happened to her. She TRUSTED Walter. This was absolutely not consensual. I know that if this were my daughter, I wouldn’t be able to stay quiet. They are all struggling with this and need our support. If not consensual, I surely hope it has been reported to the authorities.

Typically newspapers and other media operate under a code of ethics about identifying the victim in a sexual abuse case, even if her/his name is on the public record. With minors, it's always the case. Exceptions are when the alleged victim somehow chooses to allow her name in the public, as was witnessed in various sexual assault cases in the high profile arena. (The Supreme Court confirmation is an example.) So if you are wondering why "she doesn't come forward," it's that the media themselves generally agree to a silence code. If you find out who all these people are, the wisest advice is -- protect everyone who needs to be protected and say as little as necessary about everyone else. Personal opinions are nice to have, but nobody really is reaching out to hear them.

I hope you aren't insinuating what I think you are. Sexual assault is never consensual. It's literally the definition of it. You're saying since he's not actively assaulting her right now she just needs to deal with it and move on? I feel gross for you. IMO I don't think he is saying that at all. That's the reason for the question mark.

Moral failings aside, Sir Whiskers now believes that McCarty was the perfect man to create an instant buzz and attract more athleticism but a poor choice as a motivating, strategizing coach. The ball movement and defensive intensity has been far greater under Lickliter. The missing piece is DeAndre, not Walter.

Moral failings aside, Sir Whiskers now believes that McCarty was the perfect man to create an instant buzz and attract more athleticism but a poor choice as a motivating, strategizing coach. The ball movement and defensive intensity has been far greater under Lickliter. The missing piece is DeAndre, not Walter. Agree totally. Walter was the BLING...TL is the steel..not as flashy, but strong on basketball fundamentals and blue-collar work ethic. If TL can take the flashy high-hyped athletes that Walter recruited and mix them with the UE guys who have been here awhile (and teach individual skills to all), we will have a fundamentally strong team who, when working together, compete aggressively on a regular basis with frequent flashes of spotlight material! A team built on multi-layered skill levels working together - what a novel idea! Evansville has a spotlight shining on us now - IMO the basketball world is watching to see how this small university, who beat KY and who now has taken the punch from the McCarty situation and the injury to our best player, reacts....we're back up on the floor now, let's see how we battle back. Surely there are some strong warriors out there who would love the spotlight and who would welcome the attention...COMPETITORS - flashy, hardworking, dependable COMPETITORS! I hope deAndre comes back and that all the guys stay to see just how good they can be...and that the recruits decide that Evansville is just the place to highlight their talent with their team, the ACES!

The building blocks are still there for a good team. Sam is realizing what he needs to do to be a team player and once he puts 30+ minutes of that into action his play will really take off. DeAndre is DeAndre and nothing else needs to be said. Art has flashes but he’s undersized for where he plays on the floor. We will see if Coach Lick can utilize him better next year. We have solid recruits coming in next year if they all show up that will shore up other areas of weakness. Now we come to next November. It’s critical that we fill the 5-hole with a couple of big men to dominate the paint. Other teams in the Valley have them we must get a couple. Following that we must improve our guard play ala Murray St. If they can find them so can we. A point guard who can hit the pull up jumper consistently and finish at the rim is a necessity. We constantly get beat by teams whose guards can shoot and score. Coach Lick put together some mighty good teams at Butler, let’s hope he can do it again.

Hate to bump an ugly subject, but Randall Parmley had an update on his sportscast tonight.
Per Parmley:
UE still has not completed their Title IX investigation. The delay was justified as COVID related.
He spoke with the Dallas attorney handling the case for the victim, Michelle Simpson-Tuegel. They are still planning on moving ahead, just waiting on UE to finish the Title IX investigation.
McCarty has hired legal representation, but there is no comment from that side.

I am certainly no lawyer, but on the surface it appears UE followed all the protocols when McCarty got fired...even to the point of the president of university having multiple meetings with him concerning his behavior. Once WM got suspended he interfered with the investigation and was immediately terminated. Not sure how liability should fall on the school. But if I were McCarty I would be sweating bullets....I don't expect him to have a positive outcome on this matter.

A: If the Title IX investigation does indeed determine that McCarty violated it, doesn't that put UE in the cross-hairs of Simpson-Tuegel, since he wasn't immediately terminated when the first incident occurred? By their own admission they tried to counsel him. I am not sure that would cut it as it left him in a position to continue with the violations. B: If the investigation determines that McCarty did not violate Title IX, doesn't that put them in the cross-hairs of the McCarty team for wrongful termination or breach of contract? It really seems like a no win at this point for UE. I hope I am wrong here.

But having worked in management, firing someone is not always so simple (I am sure you already know that, not trying to sound insulting). Verbal and written warnings must come first and then there can be an appeal process as well. To fire someone for some type of centennial event has to be catastrophic. We will never know what the original offenses looked like concerning Walter's sexual advances/harassment. But the few things that we do know is that 1) Walter has multiple meetings with the school administrators concerning his actions 2) Something huge landed on the desk of President Pietrusxykiewicz that caused him to suspend WM immediately. So, I can only assume that whatever precipitated this was a much lesser action. 3) Pietruxykiewicz immediately fired McCarty once he knew he was interfering with the title nine investigation. Again, not that any of us may know the whole story, but I have not heard of one single thing which indicates UE did not follow due process...none. To say the least, it will be interesting as to what happens from here.

Let’s hope that UE did enough to not only ultimately terminate him but hopefully soon enough. As it definitely had to be a balancing act: that is if they terminated him too soon then they could be in trouble and secondly if they didn’t terminate him soon enough they could be in trouble. So they were definitely in a hard place and since they seemed to be headed in the right direction on the court and were starting to win that could be used against UE in the sense that they kept him longer than they should have. As somebody said it should be interesting.

I think any finding on this should hinge on whether UE did enough, within the restrictions of fair play. I think it's fair to assume UE didn't act too quickly on this; whether they acted quickly enough would depend on a lot of things. It would seem the AD's office where the buck lands.
