After researching a bit this afternoon, I have learned a few things about Title IX. Title IX has been interpreted as allowing private lawsuits against educational institutions as well as formal complaints submitted to the Department of Education.
I kind of think the alleged victim has retained an attorney and an official complaint filed with USDOE. If so, maybe UE is trying to protect the university from this litigation. If the case isn't solid, it may be in UE's interest to NOT terminate Coach McCarty. McCarty's termination could hurt their defense as it could be viewed as an admission of guilt on part of a UE faculty member.
I am starting to think this thing is not as strong of an allegation and UE is protecting themselves the best way possible. The law firm they hired may be counseling them to not terminate him.
Just my thoughts after reading a lot about Title IX. I also learned our own late Senator Birch Bayh introduced the proposal in 1972. Interesting stuff for sure. There are opponents of the law who feel men's athletics have been hampered since this was enacted.
